Defense lawyers failed to show how a misstatement of evidence in a national television broadcast about Paige Birgfeld's case should override First Amendment rights, a Mesa County judge ruled Friday. District Judge Brian Flynn denied a motion for a pretrial gag order in the case against Lester Ralph Jones, who is accused of felony murder, second-degree murder and kidnapping in Birgfeld's death on June 28, 2007.
